STANDARD TERMS OF BUSINESS
These terms and conditions are deemed accepted by you (“the customer”) in placing an order with Design by Mika Ltd (“the supplier”).
These terms and conditions supersede all terms of business previously issued by the supplier or any terms or adjustments written on any official purchase orders or letters, e-mails or faxes the customer may send to the supplier.
Form and timing of payment is cash or telegraphic transfer on or before delivery. If for any reason satisfactory payment is not made on or before the delivery date, payment shall be due and payable by the customer to the supplier immediately upon delivery and failure to pay shall attract interest at 8% above the Bank of England base rate at the date the debt becomes overdue in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
An account with 30 days payment terms can be set up after six months continuous trading.
Any risk of loss or damage of the goods is transferred to the customer upon delivery of the goods.
Bespoke orders cannot be cancelled once placed – upon the placing of this order the customer will be liable for the full purchase price, due at the date of delivery.
If you change your mind about a non bespoke purchase, please return the goods to us in the original packaging within 14 days and we will offer you an exchange or a credit note. This does not affect your legal rights, including your right to claim a refund, replacement, repair and/or compensation where the goods are faulty or misdescribed.
The delivery address is assumed to be the same address as the customer address unless agreed otherwise in writing.
This agreement cannot be assigned without the written consent of the supplier.
The maximum liability of the supplier to non consumers (as defined in The Distance Selling Regulations 2000) is £150,000, save for death or personal injury, unless otherwise agreed between the parties in writing.
All copyright, design rights and IP rights in the goods and business documentation are the property of the supplier. The customer does not have permission to utilise or infringe upon or impair such rights.
This agreement will be governed by and construed in accordance with the laws of England and each of the parties agrees to submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under this agreement.
